Section Arb 203.09 - Election of a Remedy

(a) If a consumer or lessee has elected to use the dispute settlement mechanism or the arbitration provisions established by the manufacturer, pursuant to RSA 357-D:4, I, the consumer shall be precluded from raising those particular defects before the board.

(b) A consumer or lessee who has discontinued financing or lease payments shall not be eligible to pursue a remedy under this chapter pursuant to RSA 357-D:4,II.
