Section 445B.248 - Reconstruction: Determination of whether replacement constitutes reconstruction1. The Director will determine, within 30 days of the receipt of the notice required by subsection 2 of NAC 445B.247 and any additional information he or she may reasonably require, whether the proposed replacement constitutes reconstruction.2. The Director's determination under subsection 1 must be based on:(a) The fixed capital cost of the replacements in comparison to the fixed capital cost that would be required to construct an entirely new comparable facility;(b) The estimated life of the facility after the replacements compared to the life of an entirely new comparable facility;(c) The extent to which the components being replaced cause or contribute to the emissions from the facility; and(d) Any economic or technical limitations on compliance with applicable standards of performance which are inherent in the proposed replacements.Nev.
