Rule 37.41.121 - DIRECT PROVISION OF SERVICES BY AN AREA AGENCY(1) The area agency shall primarily use subgrants or contracts with service providers to provide all services under the Older Americans Act unless the department determines the area agency's direct provision of a service is necessary to ensure an adequate supply of the service, or no other agency is able or available to provide the service.(2) The area agency may directly provide information and referral, outreach, advocacy, program development, coordination, individual needs assessment, and case management services if the department determines the area agency can perform the services more effectively and efficiently than any other agency in the planning and service area.(3) The area agency may plan, coordinate, and provide services funded under other programs if: (a) it does not use funds under the Older Americans Act for those services; and(b) it continues to meet all area agency responsibilities.Mont.
