Rule 18-17-9.12 - Penalties for Provider Due to Non-Compliance with Policy

A provider shall receive the following penalties when non-compliance with any written CCPP program policy is violated. This Rule applies to only those policy violations that do not result in an improper payment. Examples of non-compliance include but are not limited to:

1. Provider closure outside of allowable days
2. Not maintaining sign in/out sheets on site for a period of 3 (three) years
3. Not meeting training requirements by provided deadlines when policy violations occur, the following penalties will be enacted:
A. When the policy violation impacts the health and safety of children and/or staff:
a. First Identified Instance: Suspension of new certificates for a period of 6 (six) months from the date of identification of violation.
b. Second Identified Instance: Suspension from CCPP for a period of 1 (one) year from the date of identification of violation.
c. Third Identified Instance: Permanent termination from participation in the CCPP.
B. All other policy violations not resulting in an improper payment:
a. First Identified Instance: Provider receives a written warning and mandatory technical assistance related to the violation.
b. Second Identified Instance: Provider must pay a $1,000 fine and participate in mandatory technical assistance related to the violation.
c. Third Identified Instance: Permanent termination from participation in the CCPP.

Penalties for violations occur over the provider's lifetime within the CCPP. Penalties are counted as a single instance. Multiple penalties may be accrued within the same investigation.
