Section 26.03.12.02 - Definitions
A. In this chapter, the following terms have the meanings indicated.
B. Terms Defined.
(1) "Department" means the Department of the Environment.
(2) "Design capacity" means the maximum flow capacity that something is capable of providing while achieving and maintaining the level of performance for which it was designed.
(3) "Includes" means including but not limited to.
(4) "Local government" means a Maryland county, municipality, sanitary commission, sanitary district, or other local government entity or unit of it.
(5) "MGD" means million gallons per day.
(6) "Major sewerage system" means the pipes or other channels by which sewage is or is intended to be collected, conveyed, prepared for discharge and disposed of, together with all structures, pumping stations, tanks, equipment, and appurtenances used or intended to be used in its collection, conveyance, or preparation for discharge in satisfactory condition into the ground waters or other waters of the State, excluding only:
(a) Minor building connections;
(b) The plumbing systems, including pumping stations, inside the buildings served;
(c) Septic tanks and their related drain fields and other appurtenances; and
(d) Gravity sewers with diameters 15 inches or smaller.
(7) "Major water supply system" means a system consisting of all pipes or other channels, structures, pumping stations, equipment, and appurtenances by means of which water is, or is intended to be, collected, treated, or conveyed for drinking or domestic purposes, which serves, or is intended to serve, 25 or more of the same persons on a day-to-day basis at least 6 months out of the year or which serves, or is intended to serve, 15 or more residential connections, excluding only:
(a) Minor building connections;
(b) The plumbing systems, including pumping stations, inside the buildings served;
(c) Wells; and
(d) Water mains with diameters 15 inches or smaller.
(8) "Materially alters" means any alteration other than:
(a) Normal maintenance and repair;
(b) The addition of a minor building connection; or
(c) The installation of a meter, valve, or hydrant, and similar minor alterations.
(9) "Materially extends" means any extension of water mains or gravity sewers with diameters greater than 15 inches.
(10) "Minor building connection" means a pipe or other channel having a projected flow not exceeding 5,000 gallons per day average daily flow running from a particular building, structure, or other facility that it serves to that point at which it is first connected to a:
(a) Pipe or other channel that runs along a right-of-way area;
(b) Pipe or other channel which also serves other buildings; or
(c) Pumping station.
(11) "Person" includes:
(a) Any individual, partnership, firm, association, corporation, or other entity;
(b) Any receiver, trustee, guardian, personal representative, fiduciary, or representative of any kind; and
(c) The federal government, a state, a local government, or unit of them.
(12) "Pumping station" means a facility or system with a total design capacity greater than 5,000 gallons per day average daily flow that is designed to deliver water or sewage from a lower elevation to a higher elevation. The facility may include pumps, controls, and auxiliary equipment, as well as the structures containing these items.
(13) "Right-of-way area" means:
(a) A road, street, alley, or other easement or right-of-way area benefitting more than one parcel of land; and
(b) An existing or proposed road, street, alley, or other easement or right-of-way area benefitting more than one lot or parcel of land, as shown on a subdivision plat that is recorded in the local land records or as shown on a plat submitted to a governmental entity for review in connection with an intended or planned subdivision.
(14) "Sewage" means:
(a) Any human excretion or water-carried domestic waste; and
(b) A mixture of any human excretion or water-carried domestic waste with any other liquid or water-carried waste, such as manufacturing or industrial waste, street wash, rain water discharged from roofs, lawns, paved areas, etc., and ground garbage.
(15) "Sewage collection lines" means the part, if any, of a major sewerage system consisting of the pipes and other channels by which sewage is collected and conveyed to the place for its treatment and disposal, including sanitary sewer lines and force main lines, but excluding pumping stations.
(16) "Sewage treatment plant" means the part, if any, of a major sewerage system consisting of a facility, other than a septic tank, using chemical, physical, or biological processes, or all of these, to prepare sewage in a satisfactory condition for discharge into the ground waters or other waters of the State or for application on land after it is treated.
(17) Unit Process.
(a) "Unit process" means the equipment and other improvements at a water supply plant or sewage treatment plant used in each distinct step in the process of treating water or sewage.
(b) "Unit process" includes:
(i) Clarifiers;
(ii) Activated sludge aeration tanks;
(iii) Disinfection facilities;
(iv) Filtration units;
(v) Digestors; and
(vi) Belt filter presses.
(18) "Water distribution lines" means the part, if any, of a major water supply system consisting of the pipes and other channels by which water that has been prepared for human consumption is conveyed from the place of its treatment to the consumer or other user, excluding pumping stations.
(19) "Water supply plant" means the part, if any, of a major water supply system consisting of a facility using chemical, physical, or biological processes, or all of these, to prepare water that is safe for human consumption and domestic purposes, together with all water storage facilities irrespective of their location.
