Section 14.28.08.11 - Contract Award
A. The procurement officer shall determine whether a bidder or offeror is responsible.
B. The procurement officer may find that a bidder or offeror is not a responsible bidder or offeror for:
(1) Unreasonable failure by the bidder or offeror to supply information promptly in connection with a determination of responsibility under this chapter; or
(2) Any other reason indicating that the bidder or offeror does not have the:
(a) Capability in all respects to perform fully the procurement contract requirements, or
(b) Integrity and reliability that will ensure good faith performance.
C. The procurement officer shall determine whether a bid or proposal is responsive. A responsive bid or proposal contains a definite unqualified offer to perform in accordance with the terms of the solicitation.
D. The procurement contract shall be:
(1) In a form acceptable to the Authority and
(2) Approved by an assistant attorney general of the State.
E. For procurement contracts which exceed $10,000, the procurement contract shall contain the provisions required by COMAR 21.07.01-21.07.03.
F. The Executive Director may amend or delete any provision required by Regulation .11E of this chapter as the Executive Director considers necessary to further the business of the Authority.
