This Chapter establishes requirements that apply to cooling water intake structures at new and existing facilities that are subject to section 316(b) of the Clean Water Act (CWA). Cooling water intake structures not subject to requirements under sections 5 through 11 or 12 through 17 must meet requirements under section 316(b) of the CWA established by the Department on a case-by-case, best professional judgment (BPJ) basis.
