The department shall recover from a member all Medicaid funds incorrectly expended on behalf of the member in accordance with 441-Chapter 75.
(1) The department shall recover Medicaid funds expended on behalf of a member from the member's estate in accordance with 441-Chapter 75.(2) Funds received from third parties, including Medicare, by a provider other than a state mental health institute shall be reported to the department or the managed care organization, and an adjustment shall be made to a previously submitted claim.Iowa Admin.
