Sec. 5.
(a) The fire prevention and building safety commission grants approval as an authorized third party inspection agency for a period of one (1) calendar year.(b) An authorized representative from the third party inspection agency may be required to attend the fire prevention and safety commission meeting during the approval process.(c) A written order regarding the decision of the commission shall be sent to the third party inspection agency.(d) Upon authorization by the fire prevention and building safety commission, the third party inspection agency is an authorized representative of the office of the state building commissioner and acts on behalf of the office of the state building commissioner.(e) The third party inspection agency shall assure that all industrialized building systems and mobile structures are certified in compliance with the rules of the commission.(f) An order granting or denying the application shall be issued following the requirements of IC 4-21.5-3-4. If a petition for review is subsequently granted under IC 4-21.5-3-7, the order shall be deemed a preliminary determination.(g) It shall be the responsibility of the third party inspection agency to keep all information on file with the office of the state building commissioner current.
