Sec. 9.
(a) If an application for a design release has been properly submitted in accordance with section 3 of this rule, the office of the state building commissioner shall review the application and its accompanying plans and specifications in conjunction with the office of the state fire marshal.(b) If during this review, the office of the state building commissioner or the office of the state fire marshal conclude that additional information is needed to determine if the proposed system complies with the rules of the commission, the applicant may be requested to supply this additional information. If the applicant does not provide the requested additional information or documentation within thirty (30) days following the date of the request, the office of the state building commissioner may deny the application for a design release.(c) If during this review, it is determined that there are minor omissions or items contrary to the rules of the commission, but that these minor omissions or contrary items would not adversely impact life safety, a conditional design release may be issued without the submission of corrected plans or specifications. Such conditions shall be binding. (d) Before issuing a design release, the office of the state building commissioner will: (1) provide the office of the state fire marshal with the application, plans and specifications, and any other relevant information; and(2) obtain the written approval of the office of the state fire marshal for its issuance.(e) If the office of the state building commissioner determines that the applicant has demonstrated that the construction will comply with all applicable building laws and the applicant has met all other applicable requirements, the design release will be issued.(f) Under IC 22-12-7-3, the issuance or denial of a design release is governed by IC 4-21.5-3-4.
