Section 312 IAC 25-6-90 - Underground mining; hydrologic balance; postmining rehabilitation of siltation structures, diversions, impoundments, and treatment facilities

Sec. 90.

Before abandoning a permit area or seeking bond release, the person who conducts the underground mining activities shall ensure that:

(1) all temporary structures are removed and reclaimed; and
(2) all permanent sedimentation ponds, diversions, impoundments, and treatment facilities:
(A) meet the requirements of this article for permanent structures; and
(B) have been maintained properly and meet the requirements of the approved reclamation plan for permanent structures and impoundments.

The person who conducts the underground mining activities shall renovate such structures, if necessary, to meet the requirements of this article and to conform to the approved reclamation plan.
