Sec. 22.
(a) Surface mining activities shall be conducted in a manner that facilitates reclamation that will restore approximate premining recharge capacity through restoration of the capability of the reclaimed areas as a whole, excluding coal processing waste and underground development waste disposal areas and fills, to transmit water to the ground water system. The recharge capacity shall be restored to a condition that: (1) supports the approved postmining land use;(2) minimizes disturbances to the prevailing hydrologic balance in the permit area and adjacent areas; and(3) restores the recharge capacity of the mined area to approximate premining condition.(b) If the director determines that monitoring is not required under section 23(a) of this rule, the director shall waive this section.
