Section 58.01.08.554 - LICENSED OPERATOR REQUIREMENTS01.Licensed Operator Required. Owners of all community, non-transient non-community, and surface water or groundwater sources directly influenced by surface water must place the direct supervision of their PWS under the responsible charge of a properly licensed operator at all times. When the responsible operator is not available, the PWS owner must designate a substitute responsible operator.02.Responsible Charge Operator License Requirement. An operator in responsible charge of a PWS must hold a valid Idaho license equal to or greater than the classification of the PWS where the responsible charge operator is in charge as defined in Section 003.03.Water Operator License Requirement. All operating personnel at PWSs subject to these requirements making process control/system integrity decisions about water quality or quantity that can affect public health must hold a valid Idaho license.04.Water Operator License Upgrade Allowance. A twelve (12) month period will be provided to meet increased drinking water distribution system operator licensure requirements when a higher licensure level is required based on a population increase if the following requirements are met: a. The licensure increase is triggered solely by a population increase; andb. The responsible charge operator of the PWS at the time the distribution licensure requirement increases remains the responsible charge operator throughout the twelve (12) month time frame.Idaho Admin.
