A person violating the provisions of this chapter or the terms and conditions of any permit issued as provided by this chapter, shall be guilty of a petty misdemeanor, and punished as provided by law, provided, any punishment for any violation of the provisions shall not be deemed to preclude the lessee or lessor of the reservoir from bringing legal action for damages against any person for injury or destruction of property occasioned by such person while present within the public fishing area or prohibited fishing zone.
