Rule 8-A1815 - RELEASE FROM COMPETITIVE LEVEL
1815.1

A competing employee shall not be released from a competitive level while either of the following is retained in that level:

(a) An employee with a specifically limited temporary appointment; or
(b) An employee with a specifically limited temporary promotion.
1815.2

A competing employee shall not be released from a competitive level while an employee with lower retention standing is retained in that level, except as required under § 1816 when an employee is retained under a mandatory exception.

1815.3

Competing employees shall be selected for release from a competitive level in the inverse order of retention standing, beginning with the employee with the lowest retention standing on the retention register.

1815.4

When one (1) or more but not all employees with the same service dates in the same tenure category must be released from a competitive level, the ties shall be broken as follows:

(a) The employee whose position will be abolished shall be released;
(b) If still tied, the employee who has the least service at the School of Law, regardless of other creditable service, shall be released.
