Rule 29-1700 - INCOME WITHHOLDING FOR CHILD SUPPORT
1700.1

The Department shall apply to the Clerk of the Court to issue a notice of intent to withhold in all support cases being enforced under Part D of Title 4 of the Social Security Act where there are arrearages equal to thirty (30) days of support payments. No fee for this application for services shall be charged when the applicant named in a child support order is a public assistance recipient.

1700.2

In non-public assistance cases, a caretaker, custodian or responsible relative may request that the Department apply to the Court for mandatory income withholding on his or her behalf, after payment of a reasonable application fee for services, not to exceed $25.00.

1700.3

When an applicant is subject to the fee requirement prescribed in § 1700.2, the Department may, in its discretion, waive the fee.
