All food products, including those produced and packaged by a cottage food business, are subject to collection, examination and sampling/testing of food by the Department or an authorized representative, to determine if a food product is misbranded or adulterated. The Department shall collect cottage food products without cost. A component of the food sampling conducted pursuant to this section may include the performance of sample analyses in accordance with Section 4932(d)(4) of Section 2 of the Cottage Food Amendment Act of 2013 (D.C. Official Code § 7-742.02(d)(4) (2016 Supp.)).
