This chapter shall set forth rules governing the operation of the Nehemiah Community Housing Opportunity Program (Nehemiah Program), administered by the D.C. Department of Housing and Community Development (DHCD).
The purpose of the Nehemiah Program is to provide assistance to non-profit organizations for the production of new or rehabilitated housing for sale at prices affordable to District residents, and also to assist low and moderate income persons to purchase these homes.
The Nehemiah Program is established under the authority of the Housing Production Trust Fund Act of 1988, D.C. Law 7-202 (D.C. Code § 45-3101 et seq. (1990 Repl. Vol.)).
The Director, for good cause shown in writing, may waive any provision of this chapter, except the provisions of §§ 4003.3, 4003.5, 4003.6, 4003.12, 4006.2, 4006.4, 4006.9, 4007.2, 4007.8(b) and 4008.1, consistent with applicable law. All waivers shall be justified by a determination that undue hardship will result from applying the requirement and where application of the requirement would adversely affect the purpose and objectives of the Nehemiah Program.
Non-profit applicants for federal funds under the Nehemiah Housing Opportunity Grant Program administered by the U.S. Department of Housing and Urban Development shall be governed by rules published at 24 CFR Part 280 (Federal Register, Vol. 54, 97, page 22248, dated May 22, 1989). Non-profit organizations receiving funding under the federal program shall be eligible for assistance under this chapter. Federal rules shall have precedence over this chapter to the extent not inconsistent with the Act.
