Rule 8 CCR 1302-15-9 - PARK CHANGES IN USE AND HOME OWNER REMEDIES9.1 Requests for Relocation Costs - Pursuant to section 38-12-203.5(2)(a), C.R.S., a home owner(s) must submit their written demand to the landlord for the landlord to provide relocation costs to the home owner(s) at least thirty (30) days before the date of the change in use set forth in the notice required by section 38-12-203(1)(d)(II), C.R.S.9.2 Requests for Fixed Sale Price - Pursuant to section 38-12-203.5(2)(b), C.R.S., a home owner(s) may, at the home owner's or home owners' choosing, submit a written demand to the landlord for the landlord to make a binding offer to purchase their mobile home for the amount specified in sections 38-12-203.5(2)(b)(I) and (4), C.R.S., without going through the appraisal process set forth in section 38-12-203.5(2)(b)(II), C.R.S. To exercise this option, the home owner(s) must: A. Clearly state in their written demand to the landlord pursuant to section 38-12-203.5(2), C.R.S., that the home owner(s) is choosing to receive the amount specified in sections 38-12-203.5(2)(b)(I) and (4), C.R.S., without going through the appraisal process; andB. Submit their written demand to the landlord at least thirty (30) days before the date of the change in use set forth in the notice required by section 38-12-203(1)(d)(II), C.R.S.9.3 Requests for Appraisal - Pursuant to section 38-12-203.5(2)(b), C.R.S., a home owner(s) must submit their written demand to the landlord for the landlord to submit a binding offer to purchase their mobile home at least one hundred and fifty (150) days before the date of the change in use set forth in the notice required by section 38-12-203(1)(d)(II), C.R.S.9.3.1 The one hundred and fifty (150) day deadline in this Rule 9.3 does not apply if the home owner(s) chooses not to go through the appraisal process, pursuant to Rule 9.2 of these rules.9.4 Contents of Notice - Pursuant to section 38-12-203(1)(d)(II), C.R.S., the written notice of the landlord's intent to change the use of the land and evict the home owner(s) must advise the home owner(s) of the deadlines described in Rules 9.1-9.3 of these rules to demand each remedy under in section 38-12-203.5(2), C.R.S.42 CR 23, December 10, 2019, effective 12/30/201943 CR 07, April 10, 2020, effective 4/30/202043 CR 21, November 10, 2020, effective 11/30/202044 CR 21, November 10, 2021, effective 11/30/202145 CR 20, October 25, 2022, effective 10/1/202245 CR 21, November 10, 2022, effective 11/30/202247 CR 14, July 25, 2024, effective 6/17/2024, exp. 10/15/2024 (Emergency)47 CR 18, September 25, 2024, effective 10/15/2024
