Section 12031 - Definitions

For purposes of this Article, the following definitions shall apply:

(a) "Certificate of Eligibility (COE)" is the instrument that verifies a student's eligibility for MEP services, pursuant to 34 C.F.R. section 200.89(c).
(b) "Eligible community member" means a person who:
(1) is knowledgeable of the needs of migrant children, including professionals in the field of education and social and health services who work with migrant children or their families,
(2) is not a parent member,
(3) has not served on the SPAC for two or more years, and
(4) is not a Director of a Migrant Region, an employee of a Migrant Region, or an employee of the California Department of Education (CDE).
(c) "Eligible parent member" means a parent of a migrant child as defined by Education Code section 54441(a) and 34 C.F.R. section 200.81(e), who has not served on the SPAC for four or more years.
(d) "Eligible migrant child" means a child as defined by Education Code section 54441(a) and 34 C.F.R. section 200.81(e).
(e) "Operating Agency" means those agencies, organizations, or entities defined by Education Code section 54441(e).
(f) Parent advisory council or "PAC" means those parent advisory councils established by an operating agency pursuant to Education Code section 54444.2(a).
(g) "Migrant Region" means those operating agencies defined by Education Code section 54441(f).
(h) Regional Parent Advisory Council or "RPAC" means those parent advisory councils established by a Migrant Region pursuant to Education Code section 54444.2(a).
(i) "State Director" means the Migrant Education Program Administrator at the CDE.
(j) Statewide Parent Advisory Council or "SPAC" means that statewide parent advisory council established by the SSPI pursuant to Education Code section 54444.2(a)(2).
