In addition to Section 80001 and 84001, the following shall apply:
(a)(1) "Appropriately Skilled Professional" means an individual that has training and is licensed to perform the necessary medical procedures prescribed by a physician. This individual includes, but is not limited to, the following: Registered Nurse (RN); Licensed Vocational Nurse (LVN); Physical Therapist (PT); Occupational Therapist (OT); and Respiratory Therapist (RT). These professionals may include, but are not limited to, those persons employed by a home health agency, a child's authorized representative, or facilities currently licensed in California.(b) through (f) (Reserved)(g)(1) "Group Home for Children with Special Health Care Needs" means a group home as defined in Health and Safety Code section 1502(a)(22) that provides 24-hour health care and intensive support services in a homelike setting that is licensed to serve up to five children with developmental disabilities as defined in Welfare and Institutions Code section 4512. A Group Home for Children with Special Health Care Needs is different from a Specialized Group Home as defined in Section 84001(s)(4). (g)(2) through (h) (Reserved)(i)(1) "Individual health care plan" means the plan that identifies and documents the health care and intensive support services needs of a child. It is different from an "individualized health care plan" as defined in Section 84001(i)(2). (i)(2) "Individual health care team" means those individuals who develop, monitor and revise an individual health care plan for a child placed in a Group Home for Children with Special Health Care Needs. The individual health care team shall be comprised of the following: those, individuals specified in Section 84001(i)(3), who comprise an Individualized Health Care Plan Team for a child with special health care needs, the regional center service coordinator, regional center Registered Nurse and other regional center representatives as necessary; the child, and if appropriate, the child's parents, legal guardian or conservator, or authorized representative; the child's primary care physician, or other physician as designated by the regional center; the facility administrator; the facility registered nurse; and others deemed necessary for developing a comprehensive and effective plan.(i)(3) through (r) (Reserved)(s)(1) "Special health care needs" as used for a child placed in a Group Home for Children with Special Health Care Needs means a predictable and stable condition, as determined by the individual health care plan team, that can rapidly deteriorate, resulting in permanent injury or death, or that requires specialized in-home health care, as described in Welfare and Institutions Code sections 17710(a) and (g).(s)(2) through (z) (Reserved)Cal. Pursuant to Health and Safety Code section 1567.51(c)(2)(B), this regulatory action and its first readoption are deemed to be an emergency and are exempt from review by OAL and remain in effect for 180 days. A Certificate of Compliance must be transmitted to OAL by 4-22-2024 or emergency language will be repealed by operation of law on the following day.
