(a) A Group Home for Children with Special Health Care Needs is governed by the provisions of this subchapter and Chapters 1 and 5. (1) Article 8, commencing with Section 80090, of Chapter 1 shall not apply, pursuant to Welfare and Institutions Code section 4684.53(c)(2).(b) Each Group Home for Children with Special Health Care Needs shall be licensed by the Department as a Group Home and shall be certified by the Department of Developmental Services in accordance with Health and Safety Code section 1567.51(b).(c) The following sections of Title 22, California Code of Regulations, Division 6, Chapter 5, Group Homes, shall not apply to Group Homes for Children with Special Health Care Needs: (1) Section 84010.1, Term Limits for Specialized Group Homes(2) Section 84010.2, Prohibition of Dual Licensure for Specialized Group Homes(3) Section 84064.1, Additional Administrator Qualifications and Duties in Specialized Group Homes(4) Section 84065.1, Additional Personnel Requirements for Specialized Group Homes(5) Section 84065.5, Staff/Child Ratios(6) Section 84065.6, Additional Staff/Child Ratios for Specialized Group Homes(7) Section 84065.7, Night Supervision(8) Section 84066.1, Additional Personnel Records For Specialized Group Homes(9) Section 84069.2, Individualized Health Care Plans for Specialized Group Homes(10) Section 84070.1, Additional Children's Records for Specialized Group HomesCal. 1. New subchapter 7 (articles 1-6), article 1 (sections 84700-84701) and section filed 4-27-2023 as an emergency; operative 4/27/2023 (Register 2023, No. 17). A Certificate of Compliance must be transmitted to OAL by 10-24-2023 or emergency language will be repealed by operation of law on the following day.
2. New section refiled 10-17-2023 as an emergency; operative 10/24/2023 pursuant to Government Code section 11346.1(d) (Register 2023, No. 42). Pursuant to Health and Safety Code section 1567.51(c)(2)(B), this regulatory action and its first readoption are deemed to be an emergency and are exempt from review by OAL and remain in effect for 180 days. A Certificate of Compliance must be transmitted to OAL by 4-22-2024 or emergency language will be repealed by operation of law on the following day.
