Section 5 AAC 64.022 - Waters; seasons; bag, possession, annual, and size limits; and special provisions for the Kodiak Area
(a) Unless otherwise specified in this section, 5 AAC 64.051, or 5 AAC 64.060, or by an emergency order issued under AS 16.05.060, the following are the bag, possession, annual, and size limits, and special provisions for finfish and shellfish in the waters of the Kodiak Area:
(1) king salmon: may be taken from January 1 - December 31, as follows:
(A) in fresh waters:
(i) 20 inches or greater in length; bag and possession limit of two fish; annual limit of five king salmon; a harvest record is required as specified in 5 AAC 75.006;
(ii) less than 20 inches in length; bag and possession limit of 10 fish; king salmon less than 20 inches in length caught in fresh water do not count toward the annual limit;
(B) in salt waters: bag and possession limit of two fish; no size limit; no annual limit; a harvest record is not required;
(2) salmon, other than king salmon: may be taken from January 1 - December 31, as follows:
(A) 20 inches or greater in length; bag and possession limit of five fish, of which only two may be coho salmon and only two may be sockeye salmon;
(B) less than 20 inches in length; bag and possession limit of 10 fish
(3) rainbow/steelhead trout, as follows:
(A) Kodiak Road Zone:
(i) except in stocked lakes as described in (ii) of this subparagraph: from January 1 - December 31 is open only for catch and release fishing; rainbow/steelhead trout may not be possessed and any rainbow/steelhead trout caught must be released immediately; from November 1 - April 30, only artificial lures may be used in fresh water, except for landlocked lakes of Chignik Lake, Chiniak Lagoon, and Barry Lagoon;
(ii) stocked lakes: may be taken from January 1 - December 31; bag and possession limit of 10 fish, of which only one may be 20 inches or greater in length; no annual limit; for the purposes of this sub-subparagraph, "stocked lakes" include Abercrombie (Gertrude), Aural, Big, Bull, Caroline, Cicely, Dolgoi, Dragon Fly, Heitman, Horseshoe, Jack, Jupiter, Lee, Lilly, Long, Lupine, Margaret (Boy Scout), Saturn, Southern, Tanignak, and Twin Lakes;
(B) Kodiak Remote Zone: may be taken from January 1 - December 31; bag and possession limit of two fish, of which only one may be 20 inches or greater in length; annual limit of two fish 20 inches or greater in length; a harvest record is required as specified in 5 AAC 75.006;
(C) other lakes and ponds: may be taken from January 1 - December 31; bag and possession limit of two fish, of which only one may be over 20 inches in length;
(4) Arctic char/Dolly Varden: may be taken from January 1 - December 31; bag and possession limit of 10 fish; no size limit;
(5) Arctic grayling: may be taken from January 1 - December 31; bag and possession limit of 10 fish; no size limit;
(6) halibut: may be taken only from February 1 - December 31; bag limit of two fish and possession limit of four fish; no size limit;
(7) rockfish: may be taken from January 1 - December 31; bag limit of five fish and possession limit of 10 fish, of which only two fish per day and four in possession may be nonpelagic rockfish and of which only one fish per day and two in possession may be yelloweye rockfish; no size limit;
(8) lingcod: may be taken only from July 1 - December 31; bag limit of two fish and possession limit of four fish; no size limit;
(9) sharks may be taken only as specified in 5 AAC 75.012;
(10) king crab: no open season; may not be retained or possessed;
(11) Dungeness crab: may be taken from January 1 - December 31; bag and possession limit of 12 male crab; minimum size is six and one-half inches carapace width;
(12) Tanner crab: may be taken from January 1 - December 31, except that in a section of the Kodiak District specified in S AAC 35.SOS(a), the taking of Tanner crab is prohibited in waters 25 fathoms or more in depth during the 14 days immediately before the scheduled opening of a commercial Tanner crab fishing season in that section; bag and possession limit of six male crab; minimum size is five and one-half inches carapace width;
(13) other finfish and shellfish not specified in this subsection: may be taken from January 1 - December 31; no bag, possession, or size limits.
(b) The seasons, bag, possession, and size limits, and special provisions specified in this subsection are localized exceptions to those specified in (a) of this section for finfish and shellfish in the Kodiak Area:
(1) in addition to the waters specified in 5 AAC 64.051, the following waters are closed to sport fishing for salmon, as follows:
(A) all drainages on the Kodiak Road Zone flowing into Chiniak Bay, excluding the Buskin River drainage and Kalsin Pond, upstream from the Chiniak Highway are closed to sport fishing for salmon from August 1 - September 15, except that the American and Olds Rivers are open to sport fishing for king salmon from January 1 - December 31;
(B) repealed 4/25/2008;
(C) Island Lake Creek is closed to sport fishing for salmon from January 1 - December 31;
(D) repealed 4/9/2005;
(E) the Ayakulik and Karluk River drainages are closed to sport fishing for king salmon from July 26 - December 31;
(F) the Dog Salmon River drainage, including Frazier Lake, is closed to sport fishing for king salmon from July 26-December 31;
(G) Little Kitoi Bay within 500 yards of the mouth of Little Kitoi Creek and Little Kitoi Creek drainage are closed to sport fishing for salmon from August 15 - September 30;
(H) repealed 5/1/2011;
(2) repealed 4/9/2005;
(3) repealed 4/9/2005;
(4) repealed 4/9/2005;
(5) in the Saltery Cove drainage, the bag and possession limit for salmon, other than king salmon, is five fish of which only two fish may be coho salmon;
(6) the following salt waters are closed to the snagging of fish:
(A) Mission Beach: all waters between ADF&G regulatory markers at Shahafka Cove from August 1 - September 15;
(B) Mill Bay: all waters between ADF&G regulatory markers at Mill Bay from August 1 - September 15; and
(C) repealed 4/21/2024;
(7) the outlet stream to Kalsin Pond is closed to sport fishing from the Chiniak Highway to ADF&G regulatory markers located approximately 150 feet downstream.
(8) in the Kodiak Road Zone, from September 16 - December 31, the bag and possession limit for coho salmon 20 inches or greater in length is one fish, except that in the following waters the bag and possession limit for coho salmon 20 inches or greater in length is two fish:
(A) Monashka Creek and Pillar Creek;
(B) Mission Beach: all waters between ADF&G regulatory markers at Shahafka Cove;
(C) Mill Bay: all waters between ADF&G regulatory markers;
(D) Monashka Bay: all waters west of a line from Termination Point to Miller Point;
(E) Miam, Sacramento, and Saltery drainages;
(9) Repealed 6/5/2020.
(10) in the Dog Salmon River drainage, including Frazier Lake, king salmon may not be retained or possessed; all king salmon caught must be immediately released;
(11) in the waters of Chiniak Bay and Marmot Bay, west of a line from Cape Chiniak at 57° 37.10' N. lat, 152° 09.28' W. long., to Pillar Cape at 58° 08.91' N. lat, 152° 06.78' W. long., and east of a line from Head Point on Afognak Island at 57° 59.67' N. lat., 152° 46.75' W. long., to Dolphin Point at 57° 59.15' N. lat., 152° 43.40' W. long., on Whale Island and from Bird Point at 57° 55.30' N. lat., 152° 47.50' W. long., on Whale Island to Inner Point at 57° 54.05' N. lat., 152° 47.75' W. long., on Kodiak Island
(A) the bag limit for rockfish is three fish per day and six in possession, of which only two fish per day and four in possession may be nonpelagic rockfish and only one fish per day and two in possession may be yelloweye rockfish; no size limit; and
(B) charter vessel operators and crewmembers may not retain rockfish while clients are on board the vessel.
(c) In the Kodiak Remote Zone, the following bag and possession limits apply to salmon, other than king salmon:
(1) for salmon, other than king salmon, 20 inches or greater in length, the bag limit is five fish and 10 fish in possession;
(2) for salmon, other than king salmon, less than 20 inches in length, the bag and possession limit is 10 fish.
