Section 13 AAC 68.905 - DefinitionsIn this chapter, unless the context requires otherwise,
(1) "AAFIS" means the Alaska Automated Fingerprint Identification System;(2) "agency" has the meaning given in AS 12.62.900;(3) "APSIN" means the Alaska Public Safety Information Network;(4) "arrest tracking number" means a number approved by the department to identify a charge or set of charges against a person associated with one incident, arrest, charging document, or other action by a criminal justice agency;(5) "board" means the Criminal Justice Information Advisory Board established under AS 12.62.100;(6) "Board of Parole" means the board established under AS 33.16.020;(7) "central repository of criminal justice information" means the records and identification bureau of the department;(8) "charge number" means a number approved by the department to identify a criminal charge;(9) "collateral offense" means any of the following conduct, if the conduct is not charged as a crime that will result in a sentence separate from the original offense to which the conduct relates:(A) failure to comply with an order of a court in a criminal case, including violation of probation or bail conditions;(C) failure to appear in court in response to a summons issued by a law enforcement agency for a criminal offense;(10) "commissioner" means the commissioner of the Department of Public Safety;(11) "criminal history record information" has the meaning given in AS 12.62.900;(12) "criminal identification information" has the meaning given in AS 12.62.900;(13) "criminal justice activity" has the meaning given in AS 12.62.900; "criminal justice activity" includes defense of a criminal justice agency by the Department of Law involving civil litigation;(14) "criminal justice agency" has the meaning given in AS 12.62.900;(15) "criminal justice information" has the meaning given in AS 12.62.900;(16) "current offender information" has the meaning given in AS 12.62.900;(17) "department" means the Department of Public Safety;(18) "direct access" means the ability to view or change the contents of criminal justice information(A) through a terminal, computer, printer, or control unit that is connected to APSIN; or(B) by being physically present in a secure area where fingerprint cards, photographs, reports, correspondence, or other records containing criminal justice information are maintained;(19) "domestic violence" has the meaning given in AS 18.66.990;(20) "government unit" means a department, division, bureau, section, program, office, institution, or other organizational unit of government;(21) "interested person" has the meaning given in AS 12.62.900;(22) "legible" means, for a set of fingerprints, having acceptable technical quality to be processed through an automated or manual fingerprint identification system in order to positively identify a person;(23) "national criminal history system" means the criminal history record system maintained by the Federal Bureau of Investigation;(24) "nonconviction information" has the meaning given in AS 12.62.900;(25) "offense" has the meaning given in AS 12.80.060;(26) "offense code" means a description, approved by the department, of a statute, regulation, or ordinance that defines illegal conduct;(27) "past conviction information" has the meaning given in AS 12.62.900;(28) "personal descriptors" means information used to identify a person, which may consist of one or more of the following: (E) country of citizenship;(F) physical characteristics, including sex, race, height, weight, eye color, hair color, scars, marks, tattoos, and amputations;(I) deoxyribonucleic acid profile availability and location;(J) driver's license number and state of issue;(K) social security number;(L) any other identification number assigned by a government unit;(29) "prosecuting agency" means an agency authorized by law to prosecute criminal offenses;(30) "repository" means the central repository of criminal justice information;(31) repealed 11/15/2003;(32) "proof of identity" means, for a subject (A) who is a natural person, personal descriptors required either on a form provided by the department or in a format approved by the department, and one of the following: (i) a set of fingerprints;(ii) two pieces of identification presented in person by the subject to the department, one of which must be a valid picture identification issued by a government unit;(ii) a signed statement attesting, under penalty for unsworn falsification in violation of AS 11.56.210, that the personal descriptors accurately describe the person signing the statement; or(B) other than a natural person, a signed statement from the subject's board of directors, or from an individual who has the authority to bind the subject in legal transactions, that the personal descriptors accurately describe the subject.Eff. 1/10/97, Register 140; am 11/15/2003, Register 168
