Section 13 AAC 68.900 - Fees(a) Except as provided in (b) of this section, the department will charge the following fees for services provided under this chapter:(1) to process a set of fingerprints voluntarily submitted for inclusion in AAFIS under 13 AAC 68.125(a), $20;(2) to provide criminal justice information requested under 13 AAC 68.300 - 13 AAC 68.325, (A) if fingerprints are not submitted with the request, $20;(B) if fingerprints are submitted with the request, $35;(3) to provide information requested for the purpose of criminal justice research under 13 AAC 68.345, the actual cost for the department to produce the requested information;(4) to take a set of legible fingerprints, (A) for the first set, $30;(B) for each additional set taken at the same time for the same person, $10;(5) to forward a request for criminal justice information to the Federal Bureau of Investigation, a fee set by that agency.(b) The department will not charge a fee for information released under 13 AAC 68.326 - 13 AAC 68.340 or for the purpose of discovery in a criminal case.(c) Except for fingerprints submitted under 13 AAC 68.120, the repository will return a set of fingerprints submitted under this chapter if the fingerprints are not legible or are not submitted on a form or in a format provided or approved by the department, with an explanation of the correction needed. The person who submitted the fingerprints may submit one new set, attached to the original set, for no additional fee. If the second submission does not meet the requirements of this chapter, subsequent submissions are subject to the full fee for the requested service as described in (a) of this section.(d) Except for a government unit approved by the department to be billed, or a request that involves actual costs for conducting research, a fee for a service under this chapter must be submitted at the time of the request for service. A service under this chapter will be discontinued or denied if a fee check submitted for the service is returned by a financial institution for insufficient funds or is otherwise uncollectible.(e) Upon the repository's determination that the waiver or reduction of a fee is in the public interest, the repository may waive or reduce a fee for a service under this chapter.Eff. 1/10/97, Register 140; am 11/15/2003, Register 168Authority:AS 12.62.110
