Section 660-3-13-.04 - Publication(1) The IV-D agency shall distribute for publication in newspapers with general circulation throughout the state and post on the DHR website at a minimum of twice per year or monthly as deemed appropriate by the agency, the obligors who are to appear in the publication.(2) The cost for publication will be placed with the obligors included in the publication. Your name has been referred as a possible candidate for this publication. This means the Department may publish your photograph in newspapers throughout the State of Alabama and on the Department of Human Resources, Child Support Enforcement Division website as a result of failure to pay court ordered child support. Our records indicate you are not in compliance with your court ordered child support obligation(s). Further, the records of the Department of Human Resources indicate that you owe $ representing past due child support which includes interest as of ____________. You must contact the ____________ County Department of Human Resources to show cause as to why you should not be included in this publication. In addition, if you do all of the following within ninety (90) days of receipt of this notice you may avoid having your photograph published: 1. Make a child support payment to the ____________ County Department of Human Resources, Child Support Enforcement Unit, that is at least equal to the amount of support you are required to pay each month under the support order or twenty five percent (25%) of child support arrears, whichever amount is greater; 2. Provide the County Department of Human Resources, Child Support Enforcement Unit with your current address; 3. Provide the County Department of Human Resources, Child Support Enforcement Unit with verification of your place of employment, current wages, salary, and other compensation; and 4. Provide the County Department of Human Resources, Child Support Enforcement Unit with proof that you have arranged for your wages to be withheld to pay your court ordered child support. Should you fail to respond to this notice and comply with the above listed terms, your name will be submitted as a candidate for the Ten Most Wanted program. If your photograph is published, you will be charged the cost of publication. The cost of publishing your photo in statewide newspapers will be collected only after your child support debt has been satisfied. If you are currently paying your debts under a bankruptcy plan or if you are complying with court ordered terms for repayment of arrearages, please contact the County Department of Human Resources, Child Support Unit to insure that your case is updated with this information as this notice should not apply in your case. The obligor (noncustodial parent) in your child support case appears to meet all of the criteria as a candidate and we would like your permission to publish his/her photograph in statewide newspapers and on our website. This effort is being made with the hope of locating obligors who are difficult to find and have refused to support his/her child(ren) as ordered by the courts. Please complete the enclosed "Consent/Release Form" if you would like the Department to proceed. Please provide a photograph of the obligor and attach it to the form. If the obligor is in the photo with others, draw a circle around him/her to insure the correct individual is used in the publication. We regret that we are not able to return photographs submitted.
