Section 99-99-203 - Approval of project expenditures, rates

After commencement of design and construction of the project and until completion, the department of commerce shall approve expenditures for project engineering and construction and the city of Gillette shall provide monthly progress reports confirming that the construction, design and specifications for the project are being followed and complied with. At least sixty (60) days prior to the commencement of each fiscal year, the city of Gillette shall submit its proposed budget for water user rates, operation and maintenance expenses and revenues to be applied to debt service the next fiscal year, to the department of commerce. If a reasonable level of revenues exceed the city's necessary operation, maintenance and other costs for the water system and the project, the department of commerce shall certify to the state treasurer and the state loan and investment board the amount of repayment by the city to the permanent Wyoming mineral trust fund. The department of commerce shall certify to the state treasurer and state loan and investment board all such payments after reviewing proposed budgets of the city for water user rates, operation and maintenance expenses and revenue for each fiscal year.
