Section 25-10-120 - Rights of patients; commitment and treatment of persons being treated by prayer(a) The department shall adopt rules and regulations creating a bill of patient rights and establishing the procedures by which those rights may be enforced, limited or denied. (d) No person who is being treated in good faith by spiritual means alone, through prayer, by a duly accredited practitioner in accordance with the tenets and practices of a recognized church or religious denomination may be detained, hospitalized or ordered to receive treatment under this act unless: (i) A court finds by clear and convincing evidence that he is mentally ill; or (ii) If the person is a minor or is incompetent his parent or guardian consents to detention, hospitalization or treatment.
