Section 407-107 - Responsibility to accept solid waste(a) The District becomes responsible for providing a system for solid waste management, as delineated in subsection (b) of this section, when the Board of Supervisors declares the management system operational.(b) The District shall provide a system for the management of all solid waste generated therein. Such system shall be revised and amended from time to time, and shall include all facilities, both public and private, for the collection, transportation, storage, treatment, disposal, and reuse of solid waste, all of which facilities shall be subject to regulation by the District. All solid waste subject to management control and regulation by the District shall be classified in accordance with the cost of managing or disposing of the same, and charges imposed by the District for such management and disposal shall be made in accordance with such costs. The District may contract with a nonmember municipality or a private entity for the disposal or management of solid waste generated outside the boundaries of the District, provided that such contract will provide a significant benefit to the District or a member thereof, and further provided that the solid waste that is the subject of any such contract shall be subject to at least as stringent standards, conditions, and controls as solid waste generated within the District.(c) Each member municipality agrees to act as a host community in the event that the District decides to establish a solid waste management and/or material recovery facility within that member municipality.24 Appendix V.S.A. § 407-107
