This subchapter shall not govern an application or petition for:
(1) an unsafe dam order under section 1095 of this title;(2) a potable water supply and wastewater permit under subsection 1973(j) of this title;(3) a hazardous waste facility certification under section 6606 of this title; and(4) a certificate of need under section 6606a of this title.
