Section 53E-3-1101 - Prohibited discriminatory practices - Restrictions - Reporting(1) As used in this section, "prohibited discriminatory practice" means the same as that term is defined in Section 53B-1-118.(2) The state board may not: (a) establish or maintain an office, division, or employment position established to implement, develop, plan, or promote policies, procedures, practices, programs, or initiatives, regarding prohibited discriminatory practices; or(b) employ or assign an employee or a third-party whose duties for the state board include coordinating, creating, developing, designing, implementing, organizing, planning, or promoting policies, programming, training, practices, activities, and procedures relating to prohibited discriminatory practices.(3) Nothing in this section limits or prohibits the state board's authority to establish policies that are necessary to comply with state or federal law, including laws relating to prohibited discrimination or harassment.(4) The state board shall provide an update to the Education Interim Committee and Public Education Appropriations Subcommittee on the state board's compliance with this section at or before:(a) the Education Interim Committee's November interim committee meeting; and(b) the Public Education Appropriations Subcommittee December interim subcommittee meeting.Added by Chapter 3, 2024 General Session ,§ 6, eff. 7/1/2024.
