Section 26B-2-705 - Closing facility - Appeal(1) If, in any program or facility requiring a license, certificate, or certification under this part, the department finds a condition that is a clear hazard to the public health or safety, the department may immediately order that the facility restrict access and may prevent the entrance of any client onto the premises of that facility until the condition is eliminated.(2) Parties aggrieved by the actions of the department under this section may obtain an adjudicative proceeding and judicial review.Renumbered from § 26B-2-214 and amended by Chapter 267, 2024 General Session ,§ 11, eff. 5/1/2024.Renumbered from § 26-21-14 and amended by Chapter 305, 2023 General Session ,§ 142, eff. 5/3/2023.Amended by Chapter 114, 1990 General Session
