Section 603.153 - Rules Restricting Advertising or Competitive Bidding(a) The medical board may not adopt a rule restricting advertising or competitive bidding by a person regulated by the medical board under this chapter except to prohibit a false, misleading, or deceptive practice.(b) The medical board may not include in rules to prohibit a false, misleading, or deceptive practice by a person regulated by the medical board under this chapter a rule that: (1) restricts the person's use of any medium for advertising;(2) restricts the person's personal appearance or use of the person's voice in an advertisement;(3) relates to the size or duration of any advertisement by the person; or(4) restricts the use by the person of a trade name in advertising.Amended by Acts 2015, Texas Acts of the 84th Leg. - Regular Session, ch. 838,Sec. 2.103, eff. 9/1/2015.Amended by Acts 2015, Texas Acts of the 84th Leg. - Regular Session, ch. 1,Sec. 5.166, eff. 4/2/2015.Amended By Acts 2005, 79th Leg., Ch. 231, Sec. 22, eff. 9/1/2005.
