Section 601.058 - Rules Restricting Advertising or Competitive Bidding(a) The advisory board may not adopt rules restricting advertising or competitive bidding by a medical radiologic technologist except to prohibit false, misleading, or deceptive practices.(b) In adopting rules to prohibit false, misleading, or deceptive practices, the advisory board may not include a rule that: (1) restricts the use of any medium for advertising;(2) restricts the use of a medical radiologic technologist's personal appearance or voice in an advertisement;(3) relates to the size or duration of an advertisement by the medical radiologic technologist; or(4) restricts the medical radiologic technologist's advertisement under a trade name.Amended by Acts 2015, Texas Acts of the 84th Leg. - Regular Session, ch. 838,Sec. 2.013, eff. 9/1/2015.Amended by Acts 2015, Texas Acts of the 84th Leg. - Regular Session, ch. 1,Sec. 5.128, eff. 4/2/2015.Added by Acts 2001, 77th Leg., ch. 1420, Sec. 14.322(a), eff. 9/1/2001.
