Section 361.151 - Relationship of County Authority to State Authority(a) Each county has the solid waste management powers prescribed under this subchapter.(b) The exercise of the licensing authority and other powers granted to a county by this chapter does not preclude the commission from exercising the powers vested in the commission under other provisions of this chapter, including the provisions authorizing the commission to issue a permit to construct, operate, and maintain a facility to process, store, or dispose of solid waste.(c) The commission, by specific action or directive, may supersede any authority granted to or exercised by a county under this chapter.Tex.
