Section 242.324 - Civil Penalty

A person who violates this subchapter is liable to the state for a civil penalty of $1,000 for each day of violation. At the request of the department, the attorney general shall bring an action to recover a civil penalty established by this section.

The 75th Legislature enacted two versions of Subchapter I. This version of Subchapter I, comprising §§242.301 through 242.327, is effective upon the issuance of a ruling by the federal government that the system established under Acts 1997, 75th Leg., ch. 1280, Art. 1, for licensure of nursing facility administrators does not comply with federal regulations.
