Section 499.101 - Existing Units(a) The maximum capacities for the units in the institutional division are as follows:(b) It is the intent of the legislature that as case law evolves and indicates that maximum capacities established under Subsection (a) may be increased, the staff of the institutional division shall use the procedures established by this subchapter to increase those capacities. There shall be no cause of action against the institutional division for failure to take action under this subsection.Tex. Gov't. Code § 499.101
