Section 2267.059 - Interim Agreement Before or in connection with the negotiation of the comprehensive agreement, the responsible governmental entity may enter into an interim agreement with the contracting person proposing the development or operation of the qualifying project. The interim agreement may:
(1) authorize the contracting person to begin project phases or activities for which the contracting person may be compensated relating to the proposed qualifying project, including project planning and development, design, engineering, environmental analysis and mitigation, surveying, and financial and revenue analysis, including ascertaining the availability of financing for the proposed facility or facilities of the qualifying project;(2) establish the process and timing of the negotiation of the comprehensive agreement; and(3) contain any other provision related to any aspect of the development or operation of a qualifying project that the parties consider appropriate.Tex.
