Section 68-141-103 - Prohibited activities - Exceptions(a) No person or persons, business, agency, organization or other entity, whether public or private, may hold itself out as providing a poison advice service or use the term "poison control center," "poison center," or any other term that implies that it is qualified to provide advice on the treatment of poison exposures in its advertising, name, or in printed material information it furnishes to the general public unless that entity meets one of the following conditions: (1) Has been designated by the commissioner of health a regional poison control center; or(2) Is a company or organization which provides a poison information service for products or chemicals which it manufactures or distributes.(b) Nothing in this section prohibits a qualified health care professional, within such professional's level of professional expertise, from providing advice regarding poisoning or poisons to such professional's patient or patients upon request or whenever such professional deems it warranted in the exercise of such professional's professional judgment, as otherwise permitted by law.Acts 1991, ch. 393, § 4; T.C.A., § 68-43-103.
