Section 49-6-501 - Night schools generally(a) Boards of education are authorized to establish and maintain night schools for persons who are over eleven (11) years of age, under rules and regulations prescribed by the state board of education.(b) Boards of education are authorized to establish and maintain night schools for students suspended for misconduct from the public schools, under such rules and regulations as prescribed by the state board of education.(c) The night schools, when established, shall be a part of the public school system, and any funds that are available for the maintenance of that system shall be for the establishment and maintenance of night schools at the discretion of the board of education.(d) In the apportionment of all state and county school funds, the average number in attendance each night shall form the basis of distribution, and such students shall be recorded as constituting a part of the public school attendance in the same manner as pupils who attend day schools.(e) Boards of education shall, in accordance with rules and regulations prescribed by the state board of education, adopt courses of study that will best serve the locality at which the night school is located.(f) Full and complete reports of all night schools shall be made by the boards of education on forms furnished by the board of education.Acts 1925, ch. 115, § 22; Shan.
