Section 39-17-413 - Criteria for Schedule VThe commissioner of mental health and substance abuse services, upon the agreement of the commissioner of health, shall place a substance in Schedule V upon finding that:
(1) The substance has low potential for abuse relative to the controlled substances listed in Schedule IV;(2) The substance has currently accepted medical use in treatment in the United States; and(3) The substance has limited physical dependence or psychological dependence liability relative to the controlled substances listed in Schedule IV.Acts 1989, ch. 591, § 1; 2010, ch. 1100, § 65; 2012, ch. 575, § 2.
