Section 39-17-409 - Criteria for Schedule IIIThe commissioner of mental health and substance abuse services, upon the agreement of the commissioner of health, shall place a substance in Schedule III upon finding that:
(1) The substance has a potential for abuse less than the substances listed in Schedules I and II;(2) The substance has currently accepted medical use in treatment in the United States; and(3) Abuse of the substance may lead to moderate or low physical dependence or high psychological dependence.Acts 1989, ch. 591, § 1; 2010, ch. 1100, § 65; 2012, ch. 575, § 2.
