Section 721 - Constitutionality (Adm. Code Section 2901)

It is the intention of the General Assembly that, if this act cannot take effect in its entirety because of the judgment of any court of competent jurisdiction holding unconstitutional any part or parts thereof, the remaining provisions of the act shall be given full force and effect, as completely as if the part or parts held unconstitutional had not been included herein. It is the intention of the General Assembly that, if any court of competent jurisdiction shall hold unconstitutional any provisions of this act transferring to a department, board, commission, or officer the powers and duties heretofore exercised and performed by a department, board, or commission, abolished by this act, the provisions abolishing such department, board, or commission shall thereby become inoperative, and that, in such event, such department, board, or commission shall not be abolished but shall continue as prior to the passage of this act, and shall exercise its powers and perform its duties as heretofore. The remaining provisions of this act shall in any such case be given full force and effect.
