Section 1-306 - Prohibited employment(a) It is unlawful for any person, as to whom an order suspending or revoking his registration is in effect, wilfully to become or to be employed in any capacity by any broker-dealer or investment adviser or in the position of agent for an issuer without the consent of the department; and it is unlawful for any broker- dealer, investment adviser or issuer to permit such a person to become or to remain a person employed by him without the consent of the department if such broker-dealer, investment adviser or issuer knew, or in the exercise of reasonable care should have known, of such order.(b) No issuer (except for a broker-dealer registered hereunder) shall employ any person as an agent hereunder if such issuer knew, or in the exercise of reasonable care should have known, that such person has at any time within the twelve previous months participated in this State as an agent, officer or director of another issuer in the sale of securities of that issuer, which securities were registered under section 205 or 206.Amended by P.L. 678 2014 No. 52, § 15, eff. 8/9/2014.1972, Dec. 5, P.L. 1280, No. 284, § 306, effective Jan. 1, 1973.
