(a) All fees required under this act shall be fixed by the commission, by regulation and shall be subject to review in accordance with the act of June 25, 1982 (P.L. 633, No. 181), known as the "Regulatory Review Act." If the projected revenues to be generated by fees, fines and civil penalties imposed in accordance with the provisions of this act are not sufficient to match expenditures over a two-year period, the commission shall increase those fees by regulation, subject to review in accordance with the "Regulatory Review Act," such that the projected revenues will meet or exceed projected expenditures.(b) If the Bureau of Professional and Occupational Affairs determines that the fees established by the commission are inadequate to meet the minimum enforcement efforts required, then the bureau, after consultation with the commission, shall increase the fees by regulation, subject to review in accordance with the "Regulatory Review Act," so that adequate revenue is raised to meet the required enforcement effort. 1980, Feb. 19, P.L. 15, No. 9, § 407, added 1984, March 29, P.L. 162, No. 32, § 8, effective in 90 days.
