Section 391.11 - Penalties for unlicensed practice(a) Civil penalty.--The department shall have authority to assess a civil penalty of up to $500 for each day that a person engages in the wholesale distribution of prescription drugs without a license as required by this act.(b) Criminal penalty.--A person who engages in the wholesale distribution of prescription drugs without a license as required by this act commits a misdemeanor of the third degree and shall, upon conviction, be sentenced to pay a fine of not more than $2,000 and to imprisonment for not more than six months, or both, for the first violation. On the second and each subsequent conviction, the person shall be sentenced to pay a fine of not less than $5,000 nor more than $20,000 or to imprisonment for not less than six months nor more than one year, or both.1992, Dec. 14, P.L. 1116, No. 145, § 11, imd. effective.
