Section 3107 - Allocations(a) General formula.-- Except as set forth in subsection (a.1), an annual appropriation shall be distributed among the counties as follows: (1) 50% shall be allocated on a per capita basis.(2) 50% shall be allocated on a poverty level basis.(a.1) Cost-of-living increase.--Any increase in the State appropriation identified as a cost-of-living adjustment in a general appropriation act shall be distributed as a cost-of-living adjustment to all counties. The distribution of the cost-of-living adjustment shall be made after all other funds have been distributed through the formula in subsection (a).(b) Minimum.--Except as provided in subsection (c), no county shall receive a grant in an amount which is less than the amount it received in the immediately preceding fiscal year.(c) Reductions.--(1) If a reduction in funding occurs, each county's allocation shall be reduced on a pro rata basis subject to paragraph (2).(2) No county shall receive less than $50,000.(d) Data to be used to compute formula.--The most recently available data shall be used in applying the formula set forth in subsection (a).1994, Oct. 5, P.L. 531, No. 78, § 7, effective 7/1/1994.
