Section 57086 - County aid in the improvement of township streets(a) Whenever the owners of the majority of the assessed valuation of real property within any township desire any principal street within the township to be improved and maintained at the joint expense of the county and township, they may petition the board of commissioners of the township for the improvement and require the board of commissioners to make application to the county commissioners for the improvement and maintenance in accordance with the provisions of existing law.(b) If the board of commissioners refuse to act upon, or unduly delay action on, any petition for the improvement and maintenance of any street, any citizen taxpayer of the township or county may, by petition, present the facts of the matter to the court of common pleas, requesting the court to order such action thereon as the case may require. If after due hearing had before the court it shall appear that the truth of the matters alleged in the petition are sustained, the court shall make an order directing the board of commissioners to forthwith act upon the application or applications, and that the application or petition for the improvement be forthwith forwarded to the county commissioners.1931, June 24, P.L. 1206, art.
