Section 3102.303 - Applicability(a)General rule.--This chapter shall apply to any action by an authority or city to terminate, convey or transfer a water or sewer system under 53 Pa.C.S. Ch. 56 (relating to municipal authorities) which are initiated after November 1, 2005.(b)Exception.--(1) This chapter shall not apply to the merger of two or more authorities when the merger, including the conveyance of all projects, obligations and reserves, has been approved by each of the member municipalities and the merging authorities.(2) For purposes of this subsection, the term "authority" shall have the same meaning as provided in 53 Pa.C.S. § 5602 (relating to definitions). 2006, April 14, P.L. 85, No. 28, § 303, imd. effective.
