Section 6026.902 - Permits and other requirements(a) General rule.--A State or local permit or permit revision shall not be required for remediation activities undertaken entirely on the site if they are undertaken pursuant to the requirements of this act.(b) Applicable requirements.--The department may waive in whole or in part, in writing, otherwise applicable requirements where responsible persons demonstrate that any of the following apply:(1) Compliance with a requirement at a site will result in greater risk to human health, safety and welfare and the environment than alternative options.(2) Compliance with a requirement at a site will substantially interfere with natural or artificial structures or features.(3) The proposed remedial action will attain a standard of performance that is equivalent to that required under the otherwise applicable requirement through the use of an alternative method or approach.(4) Compliance with a requirement at a site will not provide for a cost-effective remedial action. The department may not waive the remediation standards established under sections 301, 302, 303 and 304.
